General Notes:
I, Absolom Huffman, of Calhoun County, West Virginia, being now in fair health for a man of my age, but having in mind the uncertainties of life, he hereby make, sign, seal and publish the following as and for my last will and testament, hereby revoking and annulling any and all former wills by me at any time heretofore made.
FIRST: I desire and direct that any personal property, left by me, shall be sold by my Executors, hereinafter named, and the proceeds thereof applied to the payment of my just debts, including those upon which I am endorser or surety, and if there shall be any residue it shall be divided between my children, A. J. Huffman, J. B. Huffman, Jake Huffman, Brown Campbell and Okey J. Huffman.
SECOND: I will devise and bequeath unto my son Okey J. Huffman, that part of my home farm on the Little Kanawha river, In Calhoun County, which is bounded substantially as follows: Beginning at a stone on the river bank located about mid-way between two drains or hollows, which run past the barn, and running thence back through the farm to a white oak on the top of the hill, thence a straight line to the corner of land, lately owned by W. F. Plant, deceased, and also a corner to a tract of land owned by Mrs. Susan R. Cook; thence running with my outside lines to the river, and thence down the river with its meanders to the place of beginning; the boundary thus devised to my son Okey J. Huffman, includes the dwelling house and the principal buildings on the farm, and is more than the share which the said Okey J. Huffman would have in my estate upon an equal division with the other heirs, but I have been making my home with him and expect to continue to do so, and he is given more than his share because of that fact.
THIRD: The residue of my said home farm I will, devise and bequeath unto my sons, A. J. Huffman, J. B. Huffman, and Jake Huffman, and to my daughter, Brown Campbell, to be held by them in equal interests.
FOURTH: These children, above named, are all the living children that I have; however I have had other children, namely Lemuel Huffman, Mahala J. Fowler, and Hannah Marshall, who are no deceased, leaving heirs, but I make no provision in this will for such heirs, my grand-children, because I consider that I have heretofore made provision for their parents during their lifetime and do not consider my estate of sufficient value to make further provision for them at this time, and it is through no lack of affection towards them that I am pursuing this course, but have them in mind and would be glad to be able to leave them something substantial, if I were able to do so, and I invoke for them, as well as those provided for, the blessings of Almighty God, and trust that no offense will be take by them, or either of them because of my lack of ability and means to do more.
FIFTH: I will, devise and bequeath any property, real or personal, of which I may die seized or possessed, other than the above herein mentioned, to my sons, A. J. Huffman, J. B Huffman, Jake Huffman, and Okey J. Huffman, and to my daughter, Brown Campbell, who are hereby constituted the residuary legatees and beneficiaries under this will.
SIXTH: I nominate and appoint my two sons, A. J. Huffman and J. B. Huffman, as the Executors of this will, and request that no surety be taken from them, as such.
In testimony thereof, I have hereunto set my hand and affixed my seal at Granstville, West Virginia, on this eighteenth day of June, nineteen hundred and fifteen, and to each of the three typewritten sheets I have my name on the margin.
A. Huffman (SEAL)
Absalom Huffman, the Testator named in the foregoing will, which with this certificate is in typewriting on three sheets on the margin of each of which his name also appears, this day in our presence signed, sealed, published and declared the foregoing paper as and for his last will and testament, and we in his presence and in the presence of each other, at his request, do hereunto subscribe out names as attesting witnesses. And we do further certify that before the signing of the said paper the words "with my outside" on the first page of said writing were erased and the word "straight" on the same page was inserted.
Given under out hands this eighteenth day of June, noneteen hundred and fifteen. Arthur G. Miller J. M. Hamilton Lorentz C. Hamilton
At a county Court, held for the county of Calhoun, at the Court House thereof, on Tuesday April 3rd, 1917, the following order was entered:
A paper writing bearing the date of eighteenth day of June, nineteen hundred and fifteen, purporting to be the last will and testament of Absalom Huffman, deceased, who had a known place of residence in the County, wherein he died, was this day presented for probate to the County Court of Calhoun County, by the Clerk of said Court in whose custody said will was left by O. J. Huffman on the 9th day of March 1917, in whose custody the said will was left by the said decedent and thereupon came Lorentz C. Hamilton, one of the subscribing witnesses to the said paper writing, and who after being duly sworn proved that at the time of the execution of said will, the said Absalom Huffman was of sound mind and disposing memory and over the age of 21 years, and that he signed the said will in his presence, and published and declared the same as and for his last will and that he, together with Arthur G. Miller and the late J. M. Hamilton, the two other subscribing witnesses, at the same time, at his request and in his presence and in the presence of each other, subscribed their names to the said will as witnesses. Whereupon the said will is hereby admitted to probate as and for the true and last will and testament of the said Absalom Huffman.
And it appears for the said will that A. J. Huffman and J. B. Huffman are nominated as executors of said will. It is therefore ordered that they be and are hereby appointed executors of said will. Whereupon the said A. J. Huffman and J. B. Huffman together with W. E. Stump and Lorentz C. Hamilton, their sureties also here present entered into and acknowledge a bond in the penalty of two thousand dollars conditioned according to law and payable to the state of West Virginia, which bond is deemed sufficient and thereupon the said A. J. Huffman and J. B. Huffman took the oath required by law as such executors.
It is therefore ordered that Bud Johnson, Hugh Johnson, and L. John Fogle be and they are hereby appointed appraisers of the said estate; who after being duly sworn shall appraise the same according to law. ------------------------------------------------------------------------------
